Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Murmurelle platform, including the website at murmurelle.com and all associated services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Platform.

You must be at least 16 years of age to use Murmurelle. By using the Platform, you represent that you are at least 16 years old and have the legal capacity to enter into a binding agreement.

If you are accessing Murmurelle on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to keep this information up to date. You must notify us immediately at support@murmurelle.com if you suspect unauthorized access to your account.

You agree to use Murmurelle only for lawful purposes and in compliance with these Terms. You agree not to: use the Platform in any way that violates applicable laws or regulations; scrape, crawl, or extract data from the Platform without written permission; attempt to gain unauthorized access to any part of the Platform; interfere with or disrupt the integrity or performance of the Platform; use the Platform to distribute spam, malware, or harmful content; resell or redistribute Platform content without written permission; impersonate another person or entity.

Murmurelle offers free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed by Stripe.

By subscribing, you authorize Murmurelle to charge your payment method on a recurring basis at the applicable subscription rate. Subscription fees are non-refundable except as described in our Refund Policy.

We reserve the right to change subscription prices with 30 days' notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

All content on the Murmurelle Platform — including trend intelligence, movement analysis, cultural shift data, AI-generated insights, text, graphics, and the Murmurelle brand — is owned by or licensed to Murmurelle and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without our express written permission.

Personal, non-commercial use of individual insights (e.g., sharing screenshots with proper attribution) is permitted provided the Murmurelle brand is clearly attributed.

If you submit any content to the Platform (such as contact form messages or feedback), you grant Murmurelle a non-exclusive, royalty-free license to use, store, and process that content for the purposes of operating and improving the Platform.

You represent that any content you submit does not violate any third-party rights and complies with these Terms.

You may terminate your account at any time by contacting us at support@murmurelle.com or through your account settings. Upon termination, your right to access the Platform will cease immediately.

We may suspend or terminate your account at any time if we determine that you have violated these Terms, with or without notice. We are not liable to you or any third party for any termination of your account.

The Murmurelle Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses.

Trend intelligence, movement analysis, and related content provided through Murmurelle are for informational purposes only and do not constitute financial, investment, legal, or professional advice. You should not rely solely on Murmurelle intelligence when making business or investment decisions.

To the fullest extent permitted by applicable law, Murmurelle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of profits, data, or goodwill.

Our total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to Murmurelle in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Murmurelle and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
